we have an officer that has been under investigation, and was put under adm. leave, for about a month, now the roster shows LWOP, and this is about 4 months now, they have already gave his vacation away to other officers.

Look in the OPM Guidlines, 5 UFC, and the Code of Federal Regulations, it states that anything over 15 days of LWOP is considered "PUNISHMENT".

You can find more of the information that you are looking for in 5 USC 75 regarding specifics about indefinate suspension without pay. Additionally there is some guidance on it on the OPM website.
