P.S. Its not just the Warden watching, any Suit in the Region or Central Office with a computer and a password can watch also. They also can zoom in so tight they can read your name tag.

That is undoubtedly why the new uniforms have your name embroidered on the shirt in nice big, bright, non-reflective letters.

I guess I need to clarify and explain our most recent issue. Our warden was working late one night and was watching R&D from his desktop. R&D had been painted earlier in the day where cells were left open to aid the paint with drying. He saw the USMS drop off some new arrest. The R&D staff placed the inmates in the cells, but did not secure the doors (wrong, I know). The warden sees this and watches them process the inmates. About twenty to thirty minutes go by and he calls one of the officers on the phone. He chit-chatted with him, asked him what time he got off and then hung up. NEVER mentioning the heinous violation or instructing the officer to correct it. The next day, the officers show up for work and are met by the Asst-Ism who instructs them to immediately report to the Warden's office. They ask if a Union Rep is needed and he replies "no, don't worry about it". They report as instructed. The warden speaks with them in a "non-formal" type meeting. He tells them of their violations after showing them the tape. When they report back to the jail, they're informed that they will be written up for violating procedures.

Any ideas?

Well truth be told, he may be a d!ck but it's in his scope of authority to do so. Whom ever says this practice is illegal is sorely mistaken. There are thousands of circumstances of bosses spying on employees in civilian jobs, now take into account that this is a governmental agency and there are "security" concerns. Employees have very little right to privacy inside the work place outside of the bathroom.

My self, I believe there is a time and a place for this stuff, not for random viewing to try and hem someone up but if there is a suspicion of illegal crap, then so be it.

If the Warden found it to be a breach of security, he needed to take immediate action, instead of waiting for the next day to talk to them. He should have called them when he saw it on the cameras.

Sounds like a violation of their Weingarten rights if they were told they did not need a Union Rep. I'd file on the ASST ISM and the Warden. Wether the meeting was intended to be formal or informal is irrelavent.

And that would be my argument in arbitration. If the breech is so serious, why was it not corrected as soon as it was discovered rather than allow it to continue? I bet he did appreciate the new paint job though.

This warden is of typical of the cowardly bureaucratic scum who dominate the Bureau of Prisons.

Correct. What occurred was a violation of the Master Agreement and federal law.

I planned on filing a ULP for the Weingarten violations. I didn't mention it because I wanted to see if I was on the same track as others. Now that I know I am, I'll be moving forward with it.

Just wish I can file on the use of cameras. There has to be something somebody filed, somewhere and won. I guess I'm looking for any CPL33 grievances or anything like that.
