Professional Liability Insurance
Something we all need to consider. Here are the two plans for federal employees that I know about. The first is for nearly all federal employees at a cost os about $25 a month. The second is for AFGE members at about $22 a month.

What Are the Benefits?
• $1 million of professional liability damage for judgments arising from acts, errors or omissions committed by you while acting within the scope of your employment
• Protection against judgments involving personal injury, bodily injury and property damage within the scope of your employment
• After you retire there is a discovery period of 36 months. No discovery period applies if benefits are cancelled due to non-payment of member benefit cost.
• Up to $200,000 to pay the costs of defense and monetary penalties during administrative proceedings for acts committed or alleged within the scope of your employment. Benefits are provided for: Internal Agency Disciplinary Proceedings and Judicial Sanctions for any monetary penalty
• Up to $100,000 to pay for the defense of any criminal proceeding or associated expenses into alleged criminal misconduct for any act, error or omission by you in your professional capacity.
• $10,000 of Accidental Death and Dismemberment protection.
• $10,000 of Identity Theft Protection.
• There is no deductible!
• Where allowable by state law, the plan includes punitive damages as part of your benefit limit.
Who Is Eligible for Benefits?
Any full-time federal employee working at least 17.5 hours per week is eligible for our Professional Liability Benefit.
When Do Benefits Begin?
Benefits are effective on the first day of the month following receipt of the application and member benefit cost payment.
Exclusions:
Benefits under this plan do not include:
• Any obligation for which the member or any carrier as his insurer may be held liable under any workers’ compensation, unemployment compensation, disability benefits law, or other similar law
• Damage arising out of willful violation of a penal statue or penal ordinance committed by or with the knowledge or consent of the member, or damages arising out of acts of fraud committed by or actual intent to deceive or defraud
• Liability assumed by the member under any contract or agreement
• Bodily injury arising out if ownership, operation or the use of any land motor vehicle designed for use principally on public highways, including any apparatus attached thereto, or any aircraft or watercraft
• Property damage to:
- Property owned, occupied by, or rented to the United States Government or member
- Property used by the member
- Property in the care or control of the member or as to which the member is for any purpose exercising physical contact (not applicable to property or persons in custody or property under lawful control)
• Any liability for hazardous substances, including asbestos
• Bodily injury or property damage resulting from accidents caused by nuclear materials

Lawsuits against federal employees are increasing at an alarming rate. Most of us are unwilling to accept that we could somehow make a mistake or that our employer or a member of the public could turn against us. But in reality, all it takes is one complaint against management, one angry supervisor, one vindictive inmate, one failed assignment, or one jealous coworker, and both your job and your personal assets could be on the line.
Because of this a Professional Liability Insurance program has been developed exclusively for members in consultation with AFGE law enforcement representatives from the Veterans Administration, Bureau of Prisons and Homeland Security. Underwritten by an “A” rated insurance company, this insurance draws on the expertise of a large, experienced law firm to give members the legal representation they deserve.
Benefits include: $1million of insurance for judgments arising from acts or errors and omissions involving personal injury, bodily injury, or property damage while you are performing within the scope of your employment; $100,000 for defense costs arising out of administrative proceedings, and $10,000 for accidental death while on the job.
What does it cover?
Federal employees for negligent acts and judgments from alleged acts, errors or omissions while in their scope of employment. This includes any civil suit for an alleged criminal act.
Federal employees for any defense costs associated with disciplinary hearings, judicial sanctions or criminal proceedings, or any investigations into the federal employee’s alleged misconduct while in the course of employment.
Who is eligible?
All federal employees, who are eligible for benefits from the American Federation of Government Employees.
How do the limits of liability apply?
$1,000,000 indemnification limit per federal employee for an alleged civil action. Defense costs associated with this civil action is in addition to the limits of liability.
$100,000 Sub-limit per federal employee for Defense Costs arising out of Administrative Proceedings.
What additional benefits are exclusive to AFGE members under this program?
AFGE members will have $10,000 in accidental death and dismemberment rider to the policy.
What is the Coverage Territory?
AFGE members are covered in their legal jurisdiction or anywhere in the world as long as the federal employee is acting in the scope of their employment.
How much does it cost?
$11.00 bi-weekly, $66.00 quarterly, $133.00 semi-annually and $266.00 annually.
Who is the underwriter?
Evanston Insurance Company, who has a financial rating from the A.M. Best of “AX” (excellent).
What role does Mass Benefits Consultants, Inc. have?
Mass Benefits will be responsible for premium collection, administrative services, claims processing and policy holder services.
What role does Benefit Advisors Group, Inc. have?
Benefit Advisors will be responsible for the distribution of marketing materials, including applications, product brochures and in coordinating organizing events with each National Vice President in his or her District.
