There is something seriously wrong with that end of the country. I say we just give California back to Mexico and be done with it. Now that I think about it, that would also solve San Francisco's problem with handing over illegal aliens to ICE. It is a good solution for everyone involved.

I'm not in corrections. I'm a civilian. I've posted here before, mostly in the 'Ask a CO' area.

Why shouldn't people be exempt? If someone gets arrested for traffic tickets, that seems different than being arrested for drugs. Even the law recognizes the difference. Strip searches are fairly invasive, there's got the be a reasonableness test applied or else you'd have police stripping people out in the street (which I think has already happened).

Personally, I like this ruling. It just provides a small hurdle to overcome before you can ask a stranger to remove their clothes.

Jails and prisons are not the street. One of the biggest ongoing problems inside of the fences is introduction of contraband. If I was arrested, (By mistake of course!) I would strip because I know I am clean anyway. I wouldn't like it but I understand it.

Think about it this way. Jails are a controlled environment where the Government temporarily takes responsibility for the care of a person whilst their legal troubles are being addressed. As such, it is important to search the newly arrived arrestees for three very important reasons:

1. The safety of jail staff.
2. The safety of the inmate population.
3. Treating everyone in the same manner and not giving the appearance of preferential treatment.

If intake personnel were restricted from searching people for certain "minor" crimes, how long do you think it would take unscrupulous characters, who often frequent our nation's jails, from taking advantage of the situation by having all manner of contraband (weapons, drugs, mobile phones, etc) from being introduced? If you don't know, probably about 10-15 minutes.

You would also see an increase in lawsuits claiming civil rights violations, as different policies for different people would create a negative perception.

This ruling only increases the danger level in our jails, for both staff and inmates. Think about it...

Or another reason not to fear going to jail.

I guess you'd have two choices. Apply for refugee status or jump the border fence!

Um, I believe these limitations to strip searches have been applied elsewhere, like Riker's Island New York. So it ain't just California.

Re: San Francisco Does it Again!

Giving back California to Mexico is a great idea, but I doubt it will ever happen. Problem is for us voters brave enough to stick it out, we get overrun by the liberals that seem to move here at every opportunity, and the others just give up, stick their tail between their legs and move out.

I had an agreement with the wife that I would move down here for the work and after I retired we would move back. When the joyous day arrived, she refused to budge. I reminded her of the "deal" and she remains firm...

So I have to live with the ups and downs of California living for the time being. Weather is great, but after that it goes downhill pretty quick.

That is poppycock! You should have written, If you want more crazy rulings like this, goto the 9th Circuit website and read the rest of their rulings. The 9th is the black sheep of the circuits, they generally do not use the Law to back up their rulings. This is a thread about the Court and their ruling in a case, not political parties, there is a thread for that subject elsewhere on this site. Don't misconstrue my thoughts here, with all that has happened over the last 18 months, I now find myself as an undecided. But I would like to see people talk positively about the candidate that they like as opposed to talking negatively about the candidate they do not like. Instead of telling me that voting for Obama will increase or continue the crazy rulings in the 9th Circuit, tell me how whoever you are voting for will stop or eliminate the crazy rulings from the 9th Circuit. These crazy rulings have been going on during the W regime, and during the Clinton regime, and the Bush regime, and the Reagan regime, and the Carter regime. I do not think the candidate dictates the crazy rulings, the Judges do!
