You know, Im REALLY getting sick of how society caters to the scumbags. Did they forget why he was in there ?? HE KILLED A COP. Thats the lowest of low. Then to investigate the C.O.s at the prison for karma ??

I saw this on the news and thought.... Damn!! Who ever saw him alive last better not have gone inside that cell.

I say.... "First time a guy has broke his own neck to die!"

I also heard that the prison is/was going to compell the employees to talk to the FBI or be fired.

I have a real problem with that because the FBI is conducting a criminal investigation and anything they say can obviously be sued against them. It would be a little different in their statement was for prison use only and confidential.

How can we be forced to rat on ourselves when criminals have the right to remain silent???

Criminals are treated too good and given way too many rights.

They can compel them to go to the interview, but they can not compel them to say anything in a criminal investigation.

At any examination of an employee, the employee has either Weingarten rights, or Miranda rights. One of the two is always in effect, but only one.

Under Weingarten rules, employees can be compelled to make a statement even if it will incriminate them in a way that leads to workplace discipline. Failing to answer fully and truthfully can be grounds for discipline. Any statements made cannot be used to prosecute the employee for a crime. And of course under Miranda rules, they have an absolute right to remain silent.

Giving an employee a Weingarten warning and then probing for information that assists in a criminal investigation is an old trick. Thankfully, courts take a very dim view of that trick.

Same goes for us street cops. But we all know that things you say to the internal investigator is supposed to be kept private. But.... will end up being passed along at the water cooler and make its way to the criminal investigation side so they know who to go after.

I believe that you should be required to provide a statement during administrative matters but during a criminal investigation... nobody should be forced to talk.

I just do not trust the system in place. IA is not your friend and we all know cops... they talk and IA is no different. IA tells the first guy in confidence and after him.... there is no expectation of privacy as it is now just gossip.
