No charges will be filed against Robin Carole Gall, who shot and killed her husband during a domestic dispute June 9 in Canon City.

“There was no reasonable likelihood of conviction” in the case, Thom LeDoux, deputy district attorney for the 11th Judicial District, said Wednesday. Brent Thomas Gall, 40, died in the shooting.

“We relied on various factors, including the circumstance of self-defense, in making the decision,” LeDoux said.

LeDoux said members of Brent Gall’s family had been notified of the decision.

“We spoke to his mother, father, brother and sister. They were understandably upset by the whole situation,” LeDoux said. Fremont County Sheriff’s deputy John Sabatino responded to a report of a disturbance at the couple’s home at 901 Kentucky.

Sabatino said he found Robin Gall, 38, on the front porch with her three children “crying profusely.”

“We found a man, later identified as Brent Gall, lying on his back in the north bedroom of the house. He was unresponsive,” Sabatino wrote in an affidavit.

Gall said she and Brent Gall had been drinking at a bar in Canon City, then a bar in Florence and finally a bar in Penrose.

When the couple got home, they argued. Robin Gall said Brent Gall pushed her left shoulder with one of his feet, almost causing her to fall over.

She said she kicked Brent Gall and tried biting and scratching him. She told Sabatino that she got a loaded gun from a bedroom and shot him.

“Robin (Gall) informed me that when she picked up the pistol it had one round in the chamber, six in the magazine and the safety was off,” Sabatino wrote in the affidavit.

She said that after she shot her husband, she threw the gun and called 911, then took her daughters outside to wait for authorities.

Brent Gall was pronounced dead of a gunshot wound to the chest by medical personnel and Fremont County Coroner Dr. Dorothy Twellman.

Robin Gall was released from the Fremont County jail Wednesday morning, where she was being held on $50,000 bail for investigation of second-degree murder.

LeDoux said staff from the Fremont County Department of Human Services were on scene when Brent Gall died, but he did not know where the couple’s children were staying.

Department staff would not comment on the whereabouts of the three daughters

She knew exactly what she was doing? She needs to be prosecuted!!!

Man those people must have got their degrees in Kentucky....I thought this was the only place someone could admit to killing or attempting to kill someone and get away scot free.
This 'woman' needs to be prosecuted but obviously she played the victim card and gets away leaving those who truly are victims to look bad. That prosecutor needs

Reminds me of a Jane Fonda movie. You know the ones where she plays a wife that plans to kill her abusive drunk husband when she could have been going to the law instead? Then after she kills her husband in a violent manner she plays the victim card and everyone sides with her for doing what she did. You would think that most people would call it 1st degree murder since it was premeditated but unfortunately people view it like the idiots in the movie and the women is set free to do it again to spouse #2.

Very Sad!! I wonder if the DA worried that her defense would bring up the false accusations of Brent being a Cowboy? I wonder if they could have brought that into trial after he was found innocent of all charges? Hmmm, I also wonder if Brent had 5X FEGLI, should be a big payoff for a killer!!

This is wrong on MANY MANY levels. How often do they peruse charges on people knowing that there is a good chance that it will not work out. But they give their best effort anyways...
