Check some of your local statues, in MO it is/was a class d,e,or f (I don't remember off the top of my head) to have urine, feces or, other bodily fluids thrown on you UNLESS, you are a correctional worker. If this assault happens due to the performace of your duties it gets jacked up to a class B felony.

Funny thing was the MODOC never used this statue to defend us until a CO went to the local sheriff's office and filed a complaint as a private citizen. Man, the Superintendent of PCC was pissed when a county sheriff showed up to serve the arrest warrent against the inmate. His mood did not improve any when his prison made the funny papers over the assault. When word got out that we did not have to wait for the DOC to prosecute, the CO's on there own would after a assault,
A) go to the hospital for evaluation
B) return to the prison and do all applicaible paper work and make copies.
C) drive form the prison to the Sheriff's department, after shift, and file
a complaint with copies of DOC paper work attached.

I hope they are still doing this over there.

This amounts to an inmate being allowed to carry a deadly weapon, but we're not allowed to know about it.. WTF is THAT? Use the "They're ALL deadly ALL the time." Attitude and you'll stay safer... It makes some medical staff pout especially when you go downtown, but if you explain it that way, they usually understand; UNLESS they are the spouse of an inmate (YES IT HAS HAPPENED TO ME!!)

EXCELLEJNT!!! I REALLY WISH MORE OFFICERS IN MORE STATES WOULD BEGIN DOING THIS... TO HELL WITH THE SUPERINTENDANT - IF HE'S TOO BUSY BEING POLITICALLY CORERECT TO PORTECT HIS STAFF, THEN HE'S "ONE OF THEM" AND NOT ONE OF US!!

Question for everyone reading this thread, when I started in corrections ten years ago I heard a story from a old hack along the lines of this thread. The story was that while being escorted and restrained a combative inmate looked in the direction of a staff member drew back his head and made the sound of hacking up a luggy(sp?) At this point the staff the inmate was facing "placed" the inmate on the ground in a emergenct use of force.
Now the staff was placed under investigation for striking a inmate in restraints and was dragged into court. I don't remember wheather is was crimanl or civil court. During the trial the staff member was exounerated of all charges by the sitting judge on the ground the Correctional staff member had the right to defend him self from a immediate threat of bodily harm. The judge made a refrence to the prison systems policy of treating all inmates as if they have contagious dieases.

Now my question is has anybody heard of this story, seen the case law, or is it just a urban legend.

I just told my husband this story last night, don't know the history of it but know that this story has been out there for a long while.

The same thing happened at the Institution where I used to work and I am sure it has happened more than once, I honestly, even today with the changing times, don't think that anyone would stand there and take getting spit in the face at without taking the inmate, restrained or not, down to the ground...I wouldn't have cared who was watching what, I would have been on the streets, and I am sure most would agree to the same.

don't think that anyone would stand there and take getting spit in the face at without taking the inmate, restrained or not, down to the ground...I wouldn't have cared who was watching what, I would have been on the streets, and I am sure most would agree to the same.

I am in complete agreement with you. I'd be out there with you. If those inmates have the right to have their medical history kept secret, then I will TAKE the right to slam anyone of them to the ground the moment that he even LOOKS like he is going to spit at me. There would be a hell of a lawsuit I am sure but all I have to say about that is "bring it on".
