Yes, but if the lawyer was presently a C.O. the AUSA probably wouldn't prosecute.

I guess the defendant wanted to petition the judge to have new counsel appointed and the judge wasn't inclined to (not before the beat down anyway). I know this is inappropriate thought, but I must admit I didn't particularly mind seeing the public defender take one to the chops.
