N.C. inmate shot and killed during escape attempt

SMITHFIELD, N.C. — A man serving a 10-year sentence for second-degree murder was shot and killed during an escape attempt about noon today, according to the N.C. Department of Correction.

Adelino Najera, 33, had scaled two fences surrounding the paint plant adjacent to Johnston Correctional Institution.

After he ignored several commands to stop, a correctional officer shot him, the Department of Correction said in a press release.

Najera was convicted in Stokes County in 2001.

The State Bureau of Investigation is on the scene and is investigating.

State law permits corrections officers to use deadly force to stop an escaping felon.

I sort of wonder what would happen in the Bureau if this were to happen one day?

They'd probably turn around and charge the officer with murdering a precious piece of government property or something.

He was just doing his job, why is the state bureau of investigation on the job? Doesn't the NCDOC have an internal affairs unit that handles use of force incidents and firearms discharges?

It's common practice to use an outside agency anytime there is a lethal use of force. We use the local PD here because WA doesn't have a state Bureau. When the family files a lawsuit for killing their "innocent" family member who was merely using the fence for a better view of the flowers, it looks a lot better if it was an uninterested party that did the investigation.

I know I've said it before and I'll say it again. NCDOC IS NOT A LAW ENFORCEMENT AGENCY [we are not peace officers but umm, "public officers" whatever that is]. This means we have to go get an LE agency [oh say the SBI, because there really is no other state agency to handle such things] when something like this happens. IAD for DOC to my knowledge only investigates matters within the prison that doesn't exactly get outside of the walls. And to be honest, my impression about DOC firearms is that their used to be a deterrent and pretty much nothing else.
