Thank you for your reply Vickie. I must point out though that your understanding of Missouri law is incorrect. As is demonstrated in the statute cited below, there is a legal exception to the prohibition against private citizens' bringing firearms onto prison grounds. As a practical matter it appears that the Department has determined that the locked trunk of a vehicle is a secure method of storage for firearms while on prison grounds, since Probation & Parole Officers and other select DOC employees are authorized to store weapons in the trunks of their vehicles. My question concerned whether or not there is a policy in place by the Missouri Department of Corrections or other executive authority that prohibits licensed employees from storing a weapon in their vehicle while parked in an institutional parking lot as the law allows other citizens to do.

Are Missouri Department of Corrections employees, who are licensed to carry concealed weapons, prohibited from storing a legally carried weapon in their vehicle while it is in a Missouri prison parking lot?

Your request was forwarded to me. I am not exactly sure what your question is and will provide two responses.



If the question is concerning a DOC employee who is carrying a weapon because of their job (probation and parole officer, member of the probation and parole fugitive unit, a member of the Central Transfer Unit, etc.), they may keep the weapon locked in the trunk of their car on prison grounds or bring it into the facility and have it locked up according to the institution’s rules. This procedure is found in the Division of Adult Institution’s Institutional Services Procedures Manual – IS20-2-1, Section III.E.3.



If the question is concerning a DOC employee who is licensed to carry a concealed weapon as a private citizen, they would not be able to bring the weapon onto the prison grounds. It is against the law for any ordinary citizen to bring a weapon onto the prison grounds. Law enforcement follows the same rules as the department’s staff that carry weapons because of their job – they can leave the weapon locked in the trunk or bring it into the prison and have it locked up according to the institution’s rules.

She finally got a clue. I finally learned that, yes Missouri DOC does have a policy preventing employees from bringing personal weapons on to institutional property even though the law allows it. So, any citizen with a concealed weapons license, including inmate associates, are perfectly within the law to store their firearm in their vehicle while parked in a Missouri prison parking lot as are certain "special" DOC employees. But, the typical Missouri DOC employee will get punished and possibly even fired for doing the same thing.

Sounds like a real fine agency...

Now we all have a clue...

You know we can't bring our personal weapons on either, but that is hopefully about to change. I got a recent e-mail about it and if I remember right, I think the union and or a congressman is trying to get changed.

H.R. 5674 all it states is that the BOP will have to provide a place for personal weapon storage for employees authorized to carry off duty. I already see where this one is going. There is still nothing in this bill that forces the institutions to change their policy on personal weapons, and them being authorized on Bureau property. That is where they wil manipulate it. They maybe made to provide the storage, but untill the policy changes you won't be able to utilize it.

We are not allowed to bring weapons on ground. even if its locked up in your vehicle. Last year we had (Maine State Prison)an inmate have his wife try and bring a gun with her into the visit room with the intent to take hostages and start shooting them until he got out. Luckily it never happened.

WARREN: A Jackson woman armed with a loaded, .40-caliber Beretta pistol allegedly tried to break her husband, a convicted murderer, out of the Maine State Prison Tuesday. Officials said Susan Watland, 46, was stopped in the parking lot by Maine State Police, thanks to a tip to prison officials. The gun she was carrying was loaded with 10 rounds of ammunition and the safety was off, according to Maine Commissioner of Corrections Martin Magnusson.

Officials had been told that a visitor would attempt to pass a gun to an inmate inside, hold people in the visitors' room hostage and “shoot someone if necessary” to break out the inmate, Magnusson said Wednesday.

Susan Watland of Jackson is scheduled to appear before a judge in Rockland Thursday morning.

Officials received the tip Sunday and had to work through a list of 1,000 inmates to determine who was involved.

While Magnusson did not want to reveal details about the tipster because the case is still under investigation, he said prison officials narrowed the list to a single suspect and were told she would be arriving Tuesday.

Maine State Police were waiting in the prison parking lot when Watland arrived. She was told to get down on the pavement and did so without incident.

The woman's husband, 44-year-old Gary Watland, was convicted last year for a 2004 murder in Anson.

Magnusson said he had to continue to let visitors come to the prison Tuesday for fear of tipping off Susan Watland. Three armed prison officials were guarding the lobby along with the Maine State Police, who were in the parking lot.

“If we had stopped visitation, it would have been a tip-off to her. We wanted it to happen yesterday,” he said, rather than giving her an opportunity to plan another breakout.

“This is one of the most serious escape attempts I’ve seen in a long time,” he said. “Because of the good work of a lot of people in different departments, we saved a lot of lives.”

Gov. John Baldacci, who had been aware of the situation since Sunday, praised Magnusson and the work of his department and the Maine State Police.

“These people did a fantastic job. Everything worked very smoothly. They saved lives and it could have been a very tragic circumstance,” Baldacci said.

No visitors were allowed in the prison Wednesday, and they likely won’t be for the rest of this week, Magnusson said.

Susan Watland is being held at the Knox County Jail on charges of aiding an escape and trafficking in prison contraband. She is expected to appear at 9 a.m. Thursday in Rockland Superior Court.

The Blethen Maine News Service reported in October 2004 that Gary Watland used a .38-caliber handgun to kill Wayne S. Crowley, 32, of Anson. The shooting followed a long night of drinking at the Watland's home, then in Anson.

Gary Watland reportedly told Blethen that he had grown up in Caribou, but had lived for 20 years in California, where he was a computer network specialist. The couple moved to Anson in August 2004. "We were trying to get away from the gangs and troublemakers and drive-by shootings," Gary Watland reportedly told Blethen.

In April 2005, Gary Watland pleaded guilty to a charge of murder, reportedly against the advice of his lawyers. He was sentenced to 25 years in prison.

According to Blethen News Service, Gary Watland has a history of mental illness.


He got another 35 years for that.
