I'd suggest first getting a consultation from Darkman, and then see if you need to lawyer up. Darkman does have lots of good experience and he can give you valuable advice without charging a retainer fee. Make sure you have EVERYTHING documented before, during and afterwards to CYA.

Yes, DOC will find every single skeleton in your closet and make you look like a disgruntled officer who should have been fired months ago. Hence, keep good documentation. You will need to decide for yourself if you want this to become a "knock-out drag-out fight" in court with lots of publicity, your job back or a quick settlement. DOC will more than likely try for a settlement to keep it out of a courtroom.

For those that think I'm omitting something, I truly am not. But let me give you the history of myself and the prison as whole to put things in perspective.

On the subject of vests, the State DID issue stab vests at one point. To every officer be it patrol or housing unit or whatever. However, the time came after a few years when the shelf life on said vests was about to run out. Rather than pay to buy a new iteration of quality vests, the satte bought out the union, offering them five percent raise or something across the board to surrender the vests. The union agreed and all state officers gave them back, happy with the raise. A memo was written which informed all officers to turn in said vests but said that new ones could be ourchased at cost to the officer provided the warden approve it.

As for me and the vest, I called ahead when I finally decided to wear one and the shift commander told me no, email him and he will forward it uop the chain for approval. So I did. The email was sent sunday night. Monday when I went into work, see the above post.

Now, me. I have been called by a veteran sergeant, " an old school prison guard in a world of correctional officers." Whether he meant that insultingly or not, only he knows. But he has a point. I can't IPC may way out of a paper bag. I've tried, but I believe in professional separation. What is that? My personal belief that Inmates are there for a reason and are not my friends. I can talk for about thirty seconds about the big game last night but then its time to move on. I do not get cuddly or friendly or close. I am not rude, just stern. Cold perhaps, but unabashedly professional.

I also have a habit of seeing things in black and white. I admit that my reigmentaion comes from perhaps my military service, perhaps my German-English upbringing, either way its legal or illegal, right or wrong, in the book or against the rules. When I see something wrong I corrected it; when an Inmate gave me lip he was told to lock in and he was written up. When I am working a tier in the ONLY PRISON WHERE INMATES HAVE KEYS TO THEIR ROOMS, I give an order I expect to be obeyed. I do not have time or resources to ask why the inmate wants to keep using the phone after I called count time. Its three orders then your ass. However, I suppose I'm not inmate friendly enough.

Before this incident with the vest, the warden never met me. He didn't know me from a hole in the ground and had I not written the email I can swear I would still have my job. I have been before the deputy warden once when I requested a transfer. he denied it. I said I couldnt work in this environment where inmates have free reign and can tell an officer they're going to kill him and nothing happens. Yes, I did rat on a lieutenant who refused to move an inmate to isolation who threatened to kill me. The LT let the IM go back to the block after he served the write up and I had to deal with his smug attitude for 3 more hours, the whole "i got away with it' thing. So, that's why I wanted a vest. To be safe when it happens.

Now, I am on probation, yes. And I am rigid SOB when it comes to rules. You tell me to count at 9, I count at 9. You tell me to cuff before searching, I cuff before searching. I don't do well when you say" no, don't cuff those Inmates, they're ok. I know the rules say were supposed to, but we dont do it like that here."

So, what could have happened? I could have been assigned to a post where my ridigness could have helped. Two months ago, a FIREARM WITH LIVE ROUNDS AND LOADED was allowed into the secure perimeter because the sallyport officer didnt feel like checking the seventh of eight vans or whatever. A LOADED GUN was inside the wire just sitting on the floor of a vehicle. I could work at the sallyport where my ridigness says every vehicle gets searchged, even if its the end of my shift and I dont feel like it.

I could have been a tower officer, a patrol officer, search room, control room, rover, visitation - anything where they want you to adhere to the rules. But instead, they decided to can me because I wanted a vest.

Am I leaving something out, no. That's my history and that's what happened. My reports are impeccable and even the deputy warden thought so - even tho he advocated firing me. I have never been written up or disciplined or whatever. My searches are flawless. I sound arrogant, but Im just enumerating what I had going for me. I never called off and was never late.

Now the union.... We had a meeting our last day of the academy when the union boss came before my graduating class. We had questions. We specifically asked - I have 18 other graduating witnesses - even if we're on probation, and we're paying FULL DUES, do we have the abolsute support of the union? President said yes. At the meting, my rep did not say ONE WORD. and he said, while on probation, I'm not a member of the union. Interesting, huh? So I'm paying for something I'm not getting.

I do plan on suing the State, the Warden, and the Union. And whatever help anyone can give me is greatly appreciated. Email me here or IM me on AIM.

That's the situation, brothers. Or ex-brothers since I guess I'm not on the job anymore.

Either way, Im depressed. But I will fight. And I hope I win.

Pretrial A tier??? Ring a bell?? sorry bud I am not buying this one... You seem like a nice enough guy and all but... I worked for them not that long ago and they were so short staffed they would not cut someone for anything short of alowing escape or contriband. I hear they are getting more bodys and are cleaning house of some of the dead weight. Maybe I will just say this. You cant be a hard ass all the time. There are times you have to understand things. I am not saying to give up the house to anyone but I am saying you should know that there are times in life when you have to play well with others. Maybe corrections is not for you. You didnt seem like you liked the job so maybe you could look in to a security officer job or somthin like that.

Don't assume the union rep is speaking for the entire union at your facility.

Who picked up the phone and called for a rep, you or the mangagement?

If management did, for all you know the guy may or have not been a real union rep.

Or he's the union rep putting in for supervisor.
