Big Problem - All Officers Please Read

I'm going to play the devil's advocate here and be realistic. I'm not trying to shoot down the guy's hopes of getting his job back, anything is possible. But.....being on probation, they can terminate you for anything......even if they did fire him for requesting a vest, they will never cop to that...they will find somewhere, somehow where he wasn't meeting performance standards. Lets be real folks.....administrations aren't stupid. They aren't going to terminate someone without good written documentation. Especially if there is a union involved and the rep was supposedly present during the meeting. My feeling here is that there is more to the story. Possibly performance issues, or something else was going on and the vest thing just took the cake.

Again.....the vest thing could possible be the whole story and I am just reading into it too deeply....maybe the admin is all screwed up......In my 10+ years in the business I have seen officers terminated for all kinds of things, but not for questioning safety issues. I just feel there is a previous history of some sort here and being on probation, well they just don't need a reason......

Sorry if I offended anyone, just stating my opinion and two cents......

One more thing while its on my mind.......I understand you are upset and probably angry....and all the advice about contacting the governor, the state, the media, etc....while may work.....I would think real hard about doing any of that if you ever want to work for a public agency of any kind again.....while you may get your point across, make them look bad, etc....personally, if I were sitting on an interview board and you were across the table at any job.....and I knew you did that sort of stuff, I wouldn't recommend you because I have to think of the reputation of my place of employment. I would have to worry about you doing that sort of thing again the first time you got pissed off at my place....if you follow what I'm saying.....again...not out to offend anyone....just stating my opinion and two cents.....

If what you said is how it really went down, then I would take Darkman up on his offer for help. Darkman is very knowledgable and really willing to help fight the administration if you are getting unjustly screwed. Good luck!

It sounds like for starters that your union rep did not stand up for you, so I'm not sure filing a grievance with the union would actually get any results. Unions are not what they used to be anymore, they used to stand up to the administration for the rights of the workers. Anymore it seems like they are there just to beat down the labor force into submitting to what the administration wants, pushing the needs of the labor force aside.

I'm telling you that going to the media about this would most likely work for you and YOU could be responsible for making a positive change to your state's DOC if the Governor decides to side with you. I'm willing to bet that you'll have more people on YOUR side regarding this matter vs. the Warden and his side.

That's all it takes to win in court. It's all a popularity contest - it really is! Your case is more popular than his by far.

Also, by suing for your job back shows people that you care about your job. What would they rather have? A person on unemployment that stays at home that they have to pay for with their taxes or somebody in a job that apparently really cares about what they do and only wants to make that job safer for everyone? It’s obvious what they’ll think – DUH!

Just get a lawyer first and seek their advice (that’s the best advice I can offer you). You can also sue the Warden directly in civil court for just about anything as well. That's bound to get his/her panties in a wad! If you win in civil court then you move on to take on the state in state court (you VS state of) and sue for punitive damages and for your job to be fully reinstated with the DOC with back pay from the date you were canned. You also demand that you want that time gone to be added towards your retirement too and all accumulated sick time and annual leave you would have earned needs be added to your work account.

Just forget Darkman and get a lawyer! I’m not doubting his abilities but a lawyer is always your best bet! If you win your case, make damn sure the state or the Warden pays the bill towards all the court costs. Why should you have to pay a dime when nothing here is your fault? Go over that with the lawyer and let them tell you what they can do for you. It’s the best place to start. Just stay positive and focus on the main goal – getting your job back.
