Hello, I was recently demoted for "Poor work performance" in which the administration could provide no documentation for. i am appealing the demotion but was wondering if anyone in the FOP has ever filed claim through the FOP. If so how did it go and was it worth the time/money?

Who currently represents the bargaining unit staff within your facility. I think it would be a good idea to first go to your union local representative at your facility.

Yes
Always start with your local grievance procedure....If you don't......the courts will kick you out later when they find out you did not follow procedures


How long have you been at the facility you got fired from.?

How long have you been employed by the Ky DOC?

Were you on any type of probation?

Now for the bad news......................


State/Federal prison systems don't just up and fire anyone without what they feel is good cause. The litigious society we now live in demands that we have , at the very least, a modicum of proof before we , as administrators, deprive , you the employee, of your job.

I find it very, very, very hard to believe the fact that you would be terminated for "Poor work performance" and the employer is unable to provide any documentation .......Ain't going to happen unless you are on probation.....and even THEN they would have to have some type of documents to prove your unsuitability for retention.

Next..........If the department terminated you for "Poor work performance" ................you would have known it was coming.......either by less than satisfactory work/performance evaluations or less than satisfactory training (FTO) reports. Those are the "proof" or documentation they used to terminate you.

You would think so. They normally have to make sure they have all documentation; that all t's are crossed and all i's are dotted.

However in attempting to look at both sides of an issue, what did they use for their justification, to execute this demotion? And, I'm not being on one side or another, it's just being my normal inquisitive self.
