Depending on where you are in New York specific to your residence, you will probably have a little bit better shot than most civilians to get a permit, to have a gun in residence and keep it. I would in your case, wait until after your employment brings you past the one year probation. That way you will have a more solid track history as a law enforcement officer with the BOP.
The facts are concerning LEOSA are that is makes it easier for you to be able to carry, (use of a firearm is still governed for off duty personnel by Federal, State, County, and municipal law and ordinances), in New York or any other State, US Territory, or D.C. Look up Title18USC Section 926B and you will find the legal information that applies to you there, and I think you can still find a memorandum dated January 31, 2005 by BOP Director Harley Lappin on Sally Port, (that is the BOP intranet site for staff access at work only), giving us his blessing on carry. You also may find more information at the local cop shop up there in New York State as to purchase, and ask around at your local firearms dealerships. Other than using your credentials to verify that you're law enforcement, it doesn't make it any easier concerning regulations and buying firearms, because you are considered to not need it while off duty, because you cannot be as if you were on duty. Also, if you get a New York permit to purchase and to carry, (I know that they are not necessarily one and the same in New York), you don't have to rely on carrying on your creds in your state. The reasoning behind that is that if you should suffer disciplinary proceedings concerning yourself, until things are cleared up or past the punitive phase, you would not be able to carry. You of course would more than likely need your creds to carry while in NYC, because of the fact that State permits to carry are not good in NYC. |

Oh, I guess LEOSA doesn't help us with purchasing.
I just didn't want to go through all the paperwork, waiting period, all that stuff. They say it sometimes takes two to six months to get a permit, and I think that it might be for one handgun. Hopefully by the time my year is up my permit will get approved. That's suck if it takes longer than that! HAHAHAHA! Oh. I'm going to be moving soon too- so I'll have to wait for that. I'll be in another county. Awesome. I was prior military and resided in NC for most of my life. Getting a permit there was five minutes and five dollars at a gun show. STAY SAFE!! |

Laws vary state to state. Here in california all LEO status gets you is exept from the handgun training certificate.
Also, if you have a memo on official letterhead, signed by your Chief you can bypass the 10 day waiting period...only problem with that is the letter must state your using the firearm for official duty. |

Some (former) officers and a (former, now convicted) Captain at MDC Brooklyn found that out the hard way.
Actually they already knew it, but tried to do it anyway.

I work at Mdc Brookyln I was able to purchase my Glock 26 without a permit all I needed was a letter of employment and my Id card and had no problem getting mine. As far as the incident KB is refering to were from allegations of inmates being beaten after 9/11 and after diobeying an order in shu and after an assualt on staff that the officer assualted has still not recovered from 2 years later. Them being convicted has nothing to do with Leosa. The permit is not nessasary for LEO's as stated in the HR218

Maybe I'm remembering it wrong, but I was sure I read some newsclips about some officers and the captain (maybe it was a lt.) getting popped for falsifying purchase authorization letters.
I'll see if I can find the reference. |
