Under Kansas law, if he works for the Kansas Department of Corrections, he is covered to carry off duty, (the usual I am not a lawyer disclaimer). However, I would recommend some sort of liability insurance to go with it, as they have had people within their administration, (from what I have understood in the past), who would refuse to back them up. The real test case for this will come in a court of law, by a KDOC officer who takes them to court, or is caught carrying concealed without a CCW/CCH permit.

Their policy for off duty carry was that the department highly suggested you carry but was not mandatory. Regardless of department policy or lack of the state laws say we can.

I worked the street for 8 years before leaving, trying a "civvy" job, then coming back to a badge. My opinion on the street was always, If you wear a badge everyday and your not a security guard you should have a gun with you. Here use mine....lol Not all officers are like that here, so to avoid any confusion I have also spent the money for my CCH. I'm covered either way. Between CCH, KSA's, and LEOSA I carry off duty.

None of this keep in mind covers those CO's who you would NEVER want to carry a gun off duty...lol

That has been my understanding of Kansas & federal law since I first researched the issue in 2004.

Kansas has also made it extremely easy for retired LEOs to qualify annually for LEOSA purposes.

Thanks for adding that about the test case...I somehow left that out. You are most likely completely correct about that. I don't have myself any liability insurance yet but need to get that base covered.
