Union Official Accused Of DUI
Lance Corcoran Arrested In San Joaquin County

October 1, 2008

STOCKTON, Calif. -- A spokesman for a powerful union representing state prison guards was arrested in San Joaquin County on suspicion of drunken driving, the California Highway Patrol said.

Lance Corcoran of the California Correctional Peace Officers Association was taken into custody on Monday night, said Mike Champion, assistant chief of the Valley Division of the CHP.

The union has been a vocal critic of Gov. Arnold Schwarzenegger and recently launched an effort to recall the governor.

Champion said a CHP officer found Corcoran at 7:20 p.m. Monday slumped behind the wheel of a vehicle parked along Eight Mile Road near West Lane. The vehicle's engine was still running.

The officer noticed that Corcoran appeared to be intoxicated, Champion said.

Corcoran was arrested and taken to a hospital in Stockton. He was later taken to jail and booked on suspicion of driving under the influence.

The CHP is expected to send paperwork regarding the case to the district attorney, who will determine if charges will be filed.

CCPOA represents the more than 30,000 correctional peace officers who work at California's prisons and youth facilities, along with the state's parole agents who supervise inmates after release.

So, parked while intoxicated is an offense in California?

Yeah, if you have the keys in the ignition and are asleep or passed out, then they should be able to get you for DUI, because he was "apparently" attempting to drive while under the influence, if you are drunk and do not have a designated driver, you can sleep anywhere, just put your keys on your tire and make sure they aren't in your pocket etc. or they will nail you.....not that I have ever done this......I am usually a designated driver and I don't mind a bit!

I know that Oklahoma's DUI statute does (or did) include "actual physical control of the vehicle". While I was at Fort Sill in 1986, we had someone busted for sleeping it off in his car (in the parking lot of Gertlestone's) instead of driving when he knew he was drunk. The keys were in his pocket when the cop woke him up, so he was in "actual physical control", and was busted for DUI. Doing the right thing instead of driving drunk cost him his Army career.

The right thing probably would be to have a designated driver or take a cab, even back then. Otherwise blend in with somewhere like a truckstop or something, where they think you are simply taking a rest break.

We had a SSG who got busted three times in Texas, and it got his career thrown out. I never knew the exact situations, but KPD at the time was kind of strict on people who were intox.
