Well desperate, you can argue the law and debate this until you are blue in the face. Your efforts are wasted. Here is the bottom line. The man in the OP was tried and convicted according to the laws and statutes of his state. There is a potential for this to have been tried as rape if the officer in question used his authority to cause duress ie: retaliation if she didn't agree to have sex. That being said we do not know the full circumstances of the case.
As far as you disagreeing with the way the laws are written and/ or enforced, get used to it. If you ever make it into corrections there are going to be literally hundreds of policies and procedures as well as laws that you will disagree with, yet will have to enforce because that will be your job. If you raise this kind of fuss over it and refuse to enforce a law/policy that you disagree with on some technicality, you will be swiftly reprimanded and if you continue you will simply be escorted out the front door. The kind of thinking you are displaying here is a very dangerous mind set inside the walls. You sound like an inmate lover, and you might actually get caught up in the sob stories they tell about how they're not good for what they are down for or how the public defender didn't do his job. You could start feeling bad for all the innocent people locked up, and cut them a break or let an infraction slide. This kind of stuff will eventually get you caught up in a major train wreck. You may want to think long and hard before you put in any more applications. Check yourself before you wreck yourself.

I will not argue the fact that I'm sure you were in the debate club; nor will I fault your tenacity. I will however argue your ability to compose clear and definable quid pro quo. You dance around a point by picking out only a small faction in the overall logic. Take this sentence for example: Suzie and Tommy played Mike Tyson's Punch Out. In the same respect Shell Shock has become Post Traumatic Stress Disorder. So your argument on the definition of rape is pointless in the eyes of the United States Judicial Code. In this respect I stand on my previous remarks and unlike you I have better things to do with my time than argue pointless semantics. You are not Bill Clinton, We are not the governing body of the impeachment hearings and I will not continue to listen to your definitions of the word IS. When you have a real point to make or say something of interest that is not related to your compulsion of I will be more than willing to listen and retort. I was wrong about one thing though; you should not be banned. Being ignorant is not grounds for banning someone but rather ignoring them.

Hey desperate if your arguing for lulz theres other places like 4chan but I really think if your looking to be a CO, debating policy and enforcing it are two different things.
Are you sure this is what you want to do, just seems like you would have more fun in a courtroom.
