yes I agree sex is not rape however having sex with a mentally challenged inmate and one is to provide care ,custody and control over. thats just sick. I mash my gas and go fast on land and water, however in my 24 years of corrections I have Never had or wanted to have sex with an Inmate.

Yes, what he did is wrong and he should be punished! BUT once again.....Why the double standard? When female correctional people have relations with male inmates they are allowed to resign and NOT prosecuted? What is equal about that?

Which is why Iowa went away from the term RAPE several years ago ....It is now Sexual Abuse...............
And Sexual contact (sexual abuse) with a inmate/patient/ward of the state CONSENTUAL OR NOT is a FELONY. By LAW.

I've seen several female staff members who were allowed to simply resign instead of being fired, much less prosecuted.
The BOP does this to avoid bad press.

Lets take the term inmate or offender out of the post. This man had sex with a MENTALLY ILL AND DIMINISHED CAPACITY PERSON. He took advantage of a person who does not have the mental ability to decide for themselves. For all you know this guy told this MENTALLY ILL person that sex was also called riding a bike. Well.. growing up this person like riding a bike.. it was fun.. sure.. lets "ride a bike."

Is that the consent you were talking about? There is a reason there are ages defined within sexual misconduct laws because (some) most children do not possess the MENTAL CAPACITY to make that decision on their own. Just because the woman in this case was above that age doesn't matter.. the fact that she has DIMINISHED CAPACITY lumps her into the same group as 15 year old girls and younger.

She did not possess all the tools to actually give consent.. thus making this unconsenual by definition and further making it RAPE. Inmate or not.

They are inmates. That cant consent to sex. It opens a big can of worms to even suggest such a thing. Next you will be saying it is ok for teachers to have consensual sex with their juvenile students.

In Iowa that is ALSO A FELONY..........and should be everywhere.

Unfortunately we here in Iowa ususally allow our staff to resign...........but that was before PREA..........now I don';t know what we would do....
We have always wanted to get the facts.............so we normally require the employee to comply with the investigation.............that makes anything they tell us inadmissiable in court.........so we end up not prosecuting either males or females.
