Assault on staff member

An inmate assaulted a staff member. And the staff member didn't want to hit back because he's afraid he might get sued. R U kidding me!!???

Why is it that they say Even if you try to defend yourself and the inmate gets hurt, you're going to hear it from the top brass, and the inmate's lawyer?

Don't I have the right to defend myself if and inmate hits my face, breaks my nose and scratches my face and then sends me to the hospital?

I'm tired of hearing that an inmate hit a staff member and the BOP is more interested on finding out if the staff provoked the inmate.

I'm sorry. But If I see an inmate attempting to attack me I will do everything in my power to defend myself. I dont see myself going to the hospital.

If an inmate assaults me I will do what ever is necessary to protect myself and worry about justifying it later. In addition I will file free world charges of assault on his butt.

Won't be the first time a thug tried to sue me, sure it won't be the last. I won't lose any sleep over it. If your justified your justified regardless of what anyone thinks. As long as you go home the same way you came in, who cares. I stressed out the very first time I was threatened with a law suit. Went and retained an attorney and everything. It hardly ever goes anywhere when it's a self-defense case, unless you use excessive force.

If this a BOP inmate, then staff need to read 5566.06 Use of Force and Application of Restraints. This is national policy. Staff that are afraid of using force are not knowledgable of policy. Staff that know policy are not afraid of using force.

Many staff members.......especially NEW staff.............are afraid of the lawsuits.

After you have went thru the scene a couple times you find out that it is not so bad. After many lawsuits, and only going to court 2 times.........and winning those two, I could care less if some idiot sues me.

The law in every state allows a citizen to defend themselves if attacked. You as a correctional staff member are a citizen of whatever state you are working in.....................therefore you are allowed to defend yourself when attacked by an inmate.

Most DOC's that I have read U.O.F. policies on ......allow staff to defend themselves.


However, we must all remember that anything we do inside the institution WILL be reviewed by the bosses ........and their bosses.......and their bosses lawyers. As long as your actions are within policy............you might get talked to but you will be ok LEGALLY. I have been in situations where I was legally right and working within policy guidelines, and still had to justify what I did several times to my bosses. SINCE I was within policy nothing happened...........

while sitting in a unit ( between rounds of course ) almost all of the policies are on Sallyport. You can save it, read it, print it.
